By calling or texting our demo phone line, or by using our chat demo, you expressly consent to the following:

4. Information We Collect
From Dental Practices: Business contact information, practice management system credentials (securely stored), workflow preferences, billing information.
From Patient Interactions: Phone call recordings and transcripts, appointment scheduling information, SMS message content, information provided during AI conversations. All patient data is processed on behalf of the dental practice and governed by our BAA.
5. How We Use Information

6. Data Retention

1. Agreement to Terms
By accessing or using TapLoop Dental AI services, you agree to be bound by these Terms of Service. If you are using our services on behalf of a dental practice, you represent that you have authority to bind that organization to these terms.
2. Description of Services
TapLoop provides AI-powered automation services for dental practices, including but not limited to: AI voice agents for phone call handling, automated SMS appointment reminders, missed call text-back services, review request automation, patient intake digitization, and demo services for prospective customers.
3. Demo Services & Marketing Consent
IMPORTANT - PLEASE READ CAREFULLY:
By calling or texting our demo phone line, or by using our chat demo, you acknowledge and agree that:
Express Consent to Marketing: You provide your prior express written consent for TapLoop to contact you at the phone number you call from (or provide) using automated telephone dialing systems, artificial or prerecorded voice messages, and/or SMS text messages, for marketing and promotional purposes regarding TapLoop services.
Not Required for Purchase: While this consent is required to use our demo services, it is not required as a condition of purchasing any TapLoop service.
Recording Consent: Your call or chat session may be recorded for quality assurance, training, and marketing follow-up purposes.
Data Collection: We will collect your phone number, call/chat content, and any information you provide during the demo.
Message Frequency: You may receive up to 5 marketing messages per month. Message and data rates may apply.

4. TCPA Compliance for Dental Practice Clients
For dental practices using our services: Our services involve automated telephone communications and text messaging to your patients. You agree to:
Obtain proper consent: You must obtain and maintain valid prior express written consent from patients before we send automated calls or text messages on your behalf, as required by the Telephone Consumer Protection Act (TCPA)
Maintain consent records: You are responsible for maintaining documentation of patient consent
Honor opt-outs: You must promptly inform us of any patient opt-out requests
Indemnification: You agree to indemnify and hold TapLoop harmless from any claims arising from TCPA violations resulting from your failure to obtain proper consent
We provide tools to help you manage consent and opt-outs, but ultimate responsibility for compliance lies with the dental practice.
5. HIPAA and PHI
If you are a covered entity under HIPAA, you agree to execute a Business Associate Agreement (BAA) with TapLoop prior to transmitting any Protected Health Information (PHI) through our services. We will only use PHI as permitted under the BAA and applicable law.
6. Fees and Payment
Fees are as stated in your service agreement or on our pricing page
Services are billed monthly in advance
One-time setup fees are due upon service commencement
We accept major credit cards and ACH payments
Late payments may result in service suspension after 15 days notice
7. Cancellation
You may cancel your subscription at any time with 30 days written notice. Upon cancellation: access to services will terminate at the end of your billing period, we will securely delete or return your data as directed, no refunds for partial months or setup fees.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAPLOOP'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
9. Disclaimer of Warranties
SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. AI RESPONSES MAY OCCASIONALLY BE INACCURATE; YOU REMAIN RESPONSIBLE FOR VERIFYING CRITICAL INFORMATION.
10. Indemnification
You agree to indemnify and hold harmless TapLoop from any claims, damages, or expenses arising from: your use of our services, your violation of these terms, your violation of any third-party rights (including TCPA, HIPAA, or patient rights), or any content or data you provide through our services.
11. Governing Law
These Terms shall be governed by the laws of the State of Arizona. Any disputes shall be resolved in the state or federal courts located in Maricopa County, Arizona.
